CIGS per crisi aziendale
per evento improvviso ed imprevisto, modifica
dei criteri
Vi comunichiamo che il 25 agosto u.s. è stato pubblicato sulla Gazzatta Ufficiale il decreto ministeriale n.46863 (in allegato) che modifica per gli anni 2009-2011, uno dei criteri di valutazione per le domande di GICS per crisi aziendale per evento improvviso ed imprevisto.
Precisiamo che il
Ministero del Lavoro aveva emanato una nota, inviatavi il 2 aprile u.s., nella
quale chiariva che tra gli eventi improvvisi ed imprevisti rientravano la
riduzione delle commesse, la perdita di quote di mercato o la riduzione del
medesimo, la difficoltà di accesso al credito o la contrazione delle
esportazioni, ecc.. L’ultimo decreto di
fatto completa quella nota e precisa che le domande di CIGS per crisi aziendale
conseguente ad un evento improvviso ed imprevisto verranno valutate anche in
assenza di un piano di risanamento.
Di conseguenza, quanto previsto dal D.M. 18 dicembre 2002 n. 31826
all’art. 1 lettera c (“Deve essere
presentato da parte dell’impresa, un piano di risanamento che, sul presupposto
delle cause che hanno determinato la situazione di crisi aziendale, definisca
le azioni intraprese o da intraprendere per il superamento delle difficoltà
dell’impresa, distinte per ciascun settore di attività dell’impresa stessa,
nonché per ciascuna unità aziendale interessata all’intervento straordinario di
integrazione salariale.”)è
superato dalle nuove disposizioni.

Semplificazione
delle modalita' di accesso al trattamento di cassa integrazione guadagni
straordinaria per crisi aziendale conseguente ad evento improvviso ed
imprevisto di cui all'articolo 1, comma 1, lettera e), del decreto ministeriale
n. 31826 del 18 dicembre 2002. (Decreto n. 46863). (09A10128) (GU n. 196 del 25-8-2009 )
IL
MINISTRO DEL LAVORO, DELLA SALUTE E DELLE POLITICHE SOCIALI
Vista la
legge 23 luglio 1991, n. 223;
Visto
l'art. 3 della legge 14 gennaio 1994, n. 20;
Visto il
decreto del Presidente della Repubblica 10 giugno 2000, n. 218;
Visto il
decreto ministeriale n. 31826 del 18 dicembre 2002;
Considerata l'attuale congiuntura
economica e finanziaria che ha determinato ricadute sull'occupazione;
Considerata, altresi', l'esigenza di favorire
il ricorso a strumenti di
sostegno al reddito volti
al mantenimento dell'occupazione,
evitando il ricorso ai licenziamenti collettivi; Ritenuto
che, nelle ipotesi di intervento
della CIGS per crisi aziendale
conseguente ad un evento
improvviso ed imprevisto, collegato all'attuale scenario di crisi nazionale
ed internazionale,
non siano prevedibili le modalita' di
fuoriuscita dalla crisi con la conseguente difficolta'
di predisporre piani di risanamento
che dovrebbero essere, in ogni caso, collegati al superamento della crisi globale;
Ritenuto, altresi', di poter
individuare, nelle medesime ipotesi di cui al capoverso precedente, al fine della fuoriuscita
dalla situazione
di crisi delle singole
imprese,
esclusivamente il superamento dell'attuale crisi che
investe il mercato nazionale ed
internazionale;
Ritenuto, pertanto, che la valutazione dei programmi
di crisi aziendale
conseguente ad evento improvviso
ed imprevisto, possa essere effettuata, a causa della crisi in
atto, anche in assenza del piano
di risanamento di cui all'art. 1,
comma 1, lettera c), del decreto ministeriale n. 31826 del 18 dicembre 2002;
Ritenuto, alla luce di quanto
sopra esposto, di limitare la modifica
di cui al capoverso
precedente agli anni 2009, 2010, 2011, in funzione del prevedibile superamento
dell'attuale fase di crisi;
Decreta:
Art. 1.
Per gli anni 2009, 2010 e 2011, ai fini
dell'approvazione del programma
di crisi aziendale
conseguente ad un evento improvviso ed imprevisto, esterno alla gestione
aziendale, di cui all'art. 1, comma 1,
lettera e), e comma 2, del decreto ministeriale n.
31826 del 18 dicembre 2002, la
fattispecie e' valutata anche in assenza del piano di risanamento di cui alla
lettera c) del medesimo art. 1, comma 1.
Il presente
decreto sara' trasmesso per il visto e la registrazione
alla Corte dei conti e
sara' pubblicato nella Gazzetta Ufficiale
della
Repubblica italiana.

Essa è l’Organismo insostituibile per gestire i rapporti ed il confronto con l'Ente Regione, sia per i temi di diretta competenza (programmazione ed interventi dell'Ente Regione per i piani commerciali e turistici) che per quelli sindacali che investono le responsabilità istituzionali e politiche dell'Ente Regione o di altre istituzioni di rilevanza regionale.
La UILTuCS Regionale in particolare svolge i seguenti compiti:
a) coordina lo sviluppo organizzativo e rivendicativo, la propaganda e la formazione;
b) promuove la costituzione delle strutture Territoriali e Provinciali e le eventuali articolazioni zonali;
c) segue il funzionamento delle organizzazioni territoriali, coordina la politica amministrativa e di bilancio delle articolazioni territoriali e provinciali di categoria;
d) interviene in prima istanza per tutte le controversie gestionali che dovessero manifestarsi nelle sedi UILTuCS territoriali e provinciali;
e) interviene, in accordo con la UILTuCS Nazionale, nei territori di competenza ove non esistessero le condizioni organizzative minime, unificando le funzioni politiche, organizzative ed amministrative del territorio interessato con quelle della UILTuCS regionale;
f) propone, in accordo con la UILTuCS Nazionale, i provvedimenti disciplinari e le gestioni straordinarie di cui al proprio Statuto ed a quello della UIL;
g) svolge le funzioni conseguenti a quanto previsto dall'art. 14 dello Statuto.
